1. Introduction

Welcome to Ganes Academy Ltd (“we”, “us”, “our”). These Terms & Conditions govern your use of the ganesacademy.co.uk website, the Ganes Academy student-/parent dashboard, desktop tutor application, and any related mobile applications (collectively the "Platform"). By accessing or using the Platform you agree to be bound by these Terms.

2. Legal Entity

Ganes Academy Ltd is a company registered in England & Wales (Company No. 13872412) with its registered office at 84 Albert Hall Mansions, Kensington Gore, London, SW7 2AQ, United Kingdom.

3. Eligibility

The Platform is designed for learners aged 14–23. If you are under 18 you must have a parent or guardian’s permission to use the Platform. By using the Platform you confirm that you meet these requirements.

4. Services

We provide: (i) a desktop tutor application for comprehensive educational service management, (ii) a secure student & parent web dashboard for homework, attendance and progress tracking, and (iii) a forthcoming mobile app offering the same dashboard features. No fees are currently charged, but we may introduce paid features in the future and will update these Terms accordingly.

5. Your Responsibilities

  • Use the Platform only for lawful purposes and in accordance with these Terms.
  • Do not upload content that is unlawful, defamatory, or infringes any third-party rights.
  • Keep login credentials secure and notify us immediately of any unauthorised use.

6. Intellectual Property

Unless otherwise stated, all content on the Platform—including AI-assisted materials, text, graphics, videos and lesson resources—is © Ganes Academy Ltd 2021-2025 or our licensors. We grant you a limited, non-exclusive, non-transferable licence for personal study. Exam-board specification wording and past-paper questions remain © their respective owners and are referenced or adapted under the UK education exceptions; they are not reproduced verbatim or made publicly available. You may not reproduce or redistribute any content without prior written permission.

7. User-Generated Content

You retain ownership of homework submissions and other material you upload (“User Content”) but grant us a worldwide, royalty-free licence to store, display and use User Content solely for providing and improving the Platform.

8. Privacy & Data Protection

Your personal data is processed in line with our Privacy Policy (ICO Registration No. ZB939229). By using the Platform you consent to the collection and processing of your data as described therein.

9. Student & Parent Data Obligations

  • Parental Consent: Parents/guardians must consent for students under 18.
  • Data Accuracy: Provide accurate, up-to-date information.
  • Rights: Parents/guardians may exercise data-protection rights on behalf of their children.
  • Educational Purpose: Student data must only be used for legitimate educational purposes.
  • Data Retention: Educational records may be retained as per our Privacy Policy, with extended retention available through our opt-in alumni program.
  • Data Breach: Suspected breaches involving student data must be reported immediately.

10. UK GDPR Compliance & Data Subject Rights

  • Personal data is processed lawfully, fairly and transparently.
  • Data is collected for specified, explicit and legitimate purposes.
  • You have comprehensive data rights as outlined in our Privacy Policy.
  • Appropriate security measures protect your data; breaches will be handled in accordance with legal requirements.

10.1 GDPR Data Subject Rights Implementation

We have implemented automated systems to ensure your GDPR rights can be exercised effectively:

  • Right to Access (Article 15): Request and receive a complete copy of all your personal data in both human-readable (PDF) and machine-readable (JSON) formats.
  • Right to Erasure (Article 17): Request complete deletion of all your personal data with automatic cascading deletion of related records.
  • Right to Data Portability (Article 20): Receive your data in a structured, commonly used format that can be transferred to another service.
  • Audit Trail Access: Request comprehensive logs showing who accessed your data, when, and for what purpose.

10.2 How to Exercise Your Rights

  • We will respond within 30 days as required by law.
  • Identity verification will be required before processing requests.
  • Complex requests may require up to 90 days with notification.
  • The first request in any 12-month period is free; excessive requests may incur administrative fees.

10.3 Data Processing Agreement

By using our services, you acknowledge and agree that:

  • We maintain comprehensive audit logs of all data access and modifications.
  • Automated deletion occurs after retention periods expire (7 years for educational records).
  • Backup copies are created before data deletion (unless you opt out).
  • All data operations are logged for security and compliance purposes.

11. Disclaimers

Educational content is provided for guidance only; we do not guarantee grade improvements. The Platform is independent and not endorsed by AQA, Pearson Edexcel, OCR or any other awarding body.

12. Limitation of Liability

To the fullest extent permitted by law, Ganes Academy Ltd shall not be liable for any indirect or consequential loss. Our total liability in connection with the Platform shall not exceed ÂŁ100.

13. Third-Party Services & Processors

We use Google Firebase (hosting, authentication, database) in the europe-west2region to store and process data, and GitHub for private source-code management (no student data). Future integrations such as Google Analytics 4 or Sentry will operate under data-processing terms and will be disclosed in our Privacy Policy.

15. Exam-Board Disclaimer

Ganes Academy is not affiliated with, endorsed by or connected to any exam board or awarding organisation. References to specification codes or past-paper styles are solely to indicate curriculum alignment.

16. Termination

We may suspend or terminate your access if you breach these Terms. Upon termination, your data will be handled in accordance with our Privacy Policy and applicable law.

17. Governing Law

These Terms are governed by the laws of England & Wales. The courts of England & Wales have exclusive jurisdiction to settle any dispute arising under them.
